Councillor vacates his seat

Council’s General Manager has been provided formal advice that Councillor Martyn Evans has vacated his seat as an Elected Member of the Derwent Valley Council.

Council’s General Manager can now formally advise that Councillor Martyn Evans has vacated his seat as an Elected Member of the Derwent Valley Council.   The vacancy has come about due to the non-attendance at three consecutive ordinary meetings of Council by Councillor Evans.  Under SCHEDULE 5 - Office of Councillors, the Local Government Act states:

3.   Vacation of office

(1) The office of a councillor becomes vacant if the councillor (c) is absent without leave from 3 consecutive ordinary meetings of the council; 

(2) If the general manager becomes aware of a vacancy, the general manager is to notify the Electoral Commissioner.

Although apologies were received for each meeting, Councillor Evans is deemed to have vacated his seat after being absent from three sequential council meetings without seeking a leave of absence.

Under Division 3 - General Provisions 342 (1) of Local Government Act, Councillor Evans’ decisions made at the November meeting are deemed valid.

The Tasmanian Electoral Commission will now conduct a recount of votes from the 2018 council elections to find a replacement for the position with the intention to have a replacement announced by 13 December.
